READ THIS FIRST: by using this Site, sending the contact form, or opting in to our communications, you accept the handling of your personal data described in this Policy, which is part of the Terms and Conditions. You can withdraw your consent at any time by writing to contacto@juliancabezast.com. This policy covers the laws of Colombia (Law 1581 of 2012), the United States (CCPA/CPRA, CAN-SPAM), and the European Union (GDPR).
Who is responsible for your data
The party responsible for handling the personal data collected through this website, juliancabezastriana.com (the “Site”), is Julian Cabezas Triana (the “Owner” or “we”), domiciled in the Republic of Colombia.
Contact channel for anything related to privacy and personal data: contacto@juliancabezast.com. This is also the channel for exercising the rights described in this policy.
What this policy covers
This Privacy Policy applies to the personal data we collect when you visit the Site, use the contact form, subscribe to our communications, interact with our ad campaigns, or hire our services.
This policy is part of the Site's Terms and Conditions and should be read together with them. It does not apply to third-party sites or platforms linked from the Site (news outlets, social networks, communities, or payment gateways), which are governed by their own policies.
What data we collect
3(A) — Data you give us
- Contact form: name, what you do, email address, phone number, and the content of your message.
- Communications: the data you include when you write to us by email or through the messaging channels we have open.
- Hiring services: billing data and details of the business relationship when you hire a service or buy a product.
3(B) — Data collected automatically
- Technical and browsing data: IP address, device and browser type, operating system, pages visited, time spent on them, and where the visit came from.
- Cookies and similar technologies: measurement and advertising identifiers, described in the Cookies section of this policy.
3(C) — Data from third-party platforms
If you interact with us through third-party platforms (for example social networks, communities, payment processors, or messaging tools), we may receive from them the data we need to help you, in line with each platform's policies.
What we use your data for
- Answer your contact requests and get ready for business conversations.
- Deliver the services you hire and manage the business relationship, including billing.
- Send you informational and marketing communications when you have opted in.
- Measure and improve how the Site, the content, and the ad campaigns work.
- Prevent fraud and abusive use of the Site.
- Meet legal, accounting, and tax obligations.
The legal bases for handling your data are: your consent (contact form and marketing), the performance of pre-contractual steps or of a contract (services you hire), our legitimate interest (security and improvement of the Site), and compliance with legal obligations.
Your rights in Colombia (habeas data)
Data handling is governed by Statutory Law 1581 of 2012, Decree 1377 of 2013, and the rules that supplement them. As the owner of the data, you have the right to:
- Access, update, and correct your personal data.
- Ask for proof of the authorization you gave for your data to be handled.
- Be told how your data has been used.
- Withdraw your authorization and/or ask us to delete your data when no legal or contractual duty requires us to keep it.
- File complaints with the Superintendency of Industry and Commerce (SIC) for breaches of data protection rules.
To exercise them, write to contacto@juliancabezast.com. Queries are answered within a maximum of ten (10) business days, extendable as the law allows, and claims within a maximum of fifteen (15) business days, under articles 14 and 15 of Law 1581 of 2012.
Visitors from the United States (CCPA/CPRA)
If you live in California or another U.S. state with applicable privacy laws, you may have the right to know what personal information we collect and why, to ask us to correct or delete it, and not to be treated differently for exercising your rights.
- We do not sell personal information as the CCPA/CPRA defines it.
- We may “share” identifiers with advertising tools (for example Meta and Google) to measure campaigns; you can opt out by writing to our contact email or by managing cookies.
- We handle verifiable requests within the timeframes set by applicable law.
Visitors from the EU and the UK (GDPR)
If you visit from the European Economic Area or the United Kingdom, you have the rights of access, rectification, erasure, objection, restriction of processing, and portability, which you can exercise by writing to our contact email. You can also file a complaint with the supervisory authority in your country.
When we rely on your consent, you can withdraw it at any time, and that does not affect the lawfulness of anything we did with your data before then.
Who we share data with
We never sell your data. We share it only with providers that deliver services to us (data processors) and only as far as needed:
- Site infrastructure: Vercel (hosting) and Cloudflare (DNS and security).
- Email and office tools: Google Workspace (contact email, documents, and spreadsheets where requests are logged).
- Measurement and advertising: Google Analytics 4, Google Ads, and Meta.
- Payments: processors such as Stripe and Hotmart when you buy a product or service; they handle your payment data under their own policies and certifications (we do not store card numbers).
- Communities and messaging: platforms such as Skool or ManyChat when you choose to use them to reach us.
- Authorities: when a valid law or court order requires it.
International transfers
Our providers may store or process data in countries other than yours, mainly in the United States. By using the Site and giving us your data, you authorize those transfers, which are made with providers that offer reasonable security safeguards and, where it applies, mechanisms recognized by law (standard contractual clauses or equivalents).
How long we keep your data
- Contact requests: for as long as the business conversation lasts, and for a reasonable time afterward to follow up.
- Clients: for as long as the business relationship lasts, and for the periods required by accounting and tax rules and by statutes of limitations.
- Marketing: until you withdraw your authorization or unsubscribe.
- Measurement data: according to the retention periods set in each tool (for example, in Google Analytics 4).
Once those periods are over, the data is securely deleted or anonymized.
Information security
We apply reasonable technical and organizational measures to protect your data: encryption in transit (HTTPS/TLS), infrastructure providers with security certifications, restricted access to information, and data minimization (we only ask for what we need).
No system is foolproof. If a security incident affects your personal data, we will notify the people affected and the competent authorities as applicable law requires.
Minors
The Site is not intended for anyone under 18 and we do not knowingly collect data from minors. If you are a parent or guardian and believe a minor gave us personal data, write to us at contacto@juliancabezast.com and we will delete it.
Artificial intelligence and automated decisions
We do not make automated decisions that have legal or otherwise significant effects on you. We may use artificial intelligence tools to help manage messages, create content for the Site, and improve our services, always reviewed by and under the responsibility of the Owner.
When an AI tool handles personal data, it does so as part of the services of the providers described in this policy and under their security safeguards; we do not use your data to train third-party models.
Marketing communications
We will only send you marketing communications if you opted in. Every message identifies the sender, uses no misleading subject lines, and includes a way to unsubscribe, in compliance with applicable law, including the CAN-SPAM Act in the United States.
You can unsubscribe at any time using the link included in every message or by writing to contacto@juliancabezast.com.
Changes to this policy
We may update this Privacy Policy to reflect legal, technical, or business changes. The current version will always be published on this page with its update date. If a change is substantial, we will announce it visibly on the Site or through the channels you authorized.
Contact and exercising your rights
For questions about this policy or to exercise any of your rights, write to contacto@juliancabezast.com with your name, the right you want to exercise, and the data your request refers to. We will reply within the applicable legal timeframes.
If you feel we did not handle your request properly, you can turn to the Superintendency of Industry and Commerce (www.sic.gov.co) in Colombia, or to the data protection authority in your country.
