IMPORTANT — PLEASE READ CAREFULLY: these Terms include your acceptance of the processing of your personal data under the Privacy Policy, limitations of liability and submission to the law and jurisdiction of the Republic of Colombia. By accessing or using the Site, sending the contact form or signing up for any service, you accept these Terms in full. If you don't agree, please don't use the Site.

Identification and acceptance

This website, juliancabezastriana.com (the “Site”), is operated by Julian Cabezas Triana (the “Owner”). Contact: contacto@juliancabezast.com.

By accessing, browsing or using the Site, you accept these Terms and Conditions, the Privacy Policy and the Cookie Policy contained in it. If you don't agree with any of these terms, please don't use the Site.

Purpose of the Site

The Site serves informational, editorial and commercial purposes: it presents the Owner's personal brand, his projects (including Método MPC and 21hourswebsite), blog articles, press appearances and contact channels for digital marketing, training and consulting services.

The information published here is not professional, financial, legal or investment advice. Any decision you make based on the content of the Site is entirely your own responsibility.

Acceptable use

You agree to use the Site lawfully, without infringing the rights of others, without trying to reach restricted areas, interfere with how it works, extract data in bulk (scraping) or introduce malicious software.

The Owner may suspend or restrict access to the Site for anyone who breaks these terms, without prior notice.

Intellectual property

All the content on the Site — text, brand, logos, photographs, videos, designs, code and structure — belongs to the Owner or is used with the permission of its owners, and is protected by the intellectual property laws of Colombia (Law 23 of 1982 and related regulations), of the United States and by international treaties.

The media logos shown in the press section belong to their respective owners and are used only as a journalistic reference to real appearances by the Owner in those outlets.

You may not reproduce, distribute or commercially exploit the content of the Site without prior written permission from the Owner. You are welcome to share links to the content, citing the source.

Processing of personal data

The Owner acts as the Data Controller for the personal data collected through the Site (for example: name, occupation, email address, phone number and the content of your messages in the contact form), in accordance with Colombia's Statutory Law 1581 of 2012, Decree 1377 of 2013 and any regulations that complement them.

The full detail of that processing — what data we collect, what for, which third parties have access, international transfers, retention periods and how to exercise your rights in Colombia, the United States and the European Union — is in the Privacy Policy, which is an integral part of these terms.

As the owner of your data you have the right to access, update, correct and delete it, to request proof of your authorization, to be told how it is used, to file a complaint with Colombia's Superintendence of Industry and Commerce (SIC) and to withdraw your authorization at any time by writing to contacto@juliancabezast.com.

Visitors from the United States and other countries

If you visit from the United States, and California in particular, you may have additional rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know what personal information we collect, to request its deletion and not to be treated differently for exercising your rights. The Owner does not “sell” personal information as the CCPA defines that term.

If you visit from the European Economic Area or the United Kingdom, the processing of your data relies on the lawful bases of the GDPR (consent, steps taken before entering into a contract, and legitimate interest), and you can exercise your rights of access, rectification, erasure, objection, restriction and portability by writing to the contact email.

The Site is hosted on third-party infrastructure that may process data outside your country of residence; by using it, you consent to those transfers with whatever safeguards apply.

Cookies and similar technologies

The Site uses or may use cookies and similar technologies of three kinds: (a) technical or essential ones, needed for the Site to work; (b) analytics ones (for example Google Analytics 4), which help us understand how the Site is used; and (c) marketing ones (for example Meta Pixel and Google Ads tags), which make it possible to measure campaigns and build remarketing audiences.

Where the law requires it, non-essential cookies are only turned on with your consent, which you can give or withdraw from the Site's cookie banner. You can also block or delete cookies from your browser settings; doing so may affect some features. More detail in the Privacy Policy.

Communications and marketing

If you leave us your details to receive content, news or offers, we will write to you through the channels you authorized (for example email or messaging). You can unsubscribe at any time using the link included in every message or by writing to the contact email.

Commercial communications follow the applicable rules, including the United States CAN-SPAM Act for commercial email: they identify the sender, they don't use misleading subject lines and they include a way to opt out.

Content assisted by artificial intelligence

Some of the Site's content (text, images, summaries or graphics) may be created or assisted by artificial intelligence tools, always under the Owner's editorial review and responsibility.

The Owner works to keep the content accurate, but can't guarantee it is free of errors. If you spot something inaccurate, we appreciate a note to the contact email.

Links and third-party services

The Site links to third-party sites (media outlets, the Owner's projects, social networks, payment or scheduling platforms). The Owner does not control and is not responsible for the content, policies or privacy practices of those sites; please review them before using them.

Purchases or subscriptions you make on third-party platforms (for example payment processors or communities) are governed by those platforms' terms, along with the specific conditions of the service you agree on with the Owner.

Limitation of liability

The Site is offered “as is” and “as available”. To the fullest extent permitted by law, the Owner will not be liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the Site, nor for interruptions, errors, viruses or data loss that are not directly attributable to him.

Nothing in these terms limits rights the law gives you as a consumer that cannot be waived.

Minors

The Site is not intended for people under 18 and the Owner does not knowingly collect data from minors. If you are a parent or guardian and believe a minor gave us their data, write to us and we will delete it.

Changes to these terms

The Owner may change these Terms and Conditions at any time. The version in force will always be published on this page with its update date. Using the Site after a change means you accept it.

Governing law and jurisdiction

These terms are governed by the laws of the Republic of Colombia. Any dispute will be brought before the competent courts of Colombia, without prejudice to the mandatory consumer protection or personal data rules that apply in your country of residence (including the United States).

If any clause is found invalid, the rest stay fully valid.
